Asbestos Surveys and Management Plans

The in’s and out’s of Asbestos Identification and Reporting for Residential Properties (including Rental properties), workplaces and Commercial Buildings.

The Health and Safety at Work (Asbestos) Act 2016 contains obligations regarding reporting on asbestos. These obligations are being more stringently enforced by Councils and Worksafe.

As a building owner and a PBCU (Person Conducting a Business or Undertaking) you need to reasonably know if there is a risk of exposure to asbestos fibers in your workplace or building. This is to ensure the health and wellbeing of tenants, contractors, visitors, and anyone else who may be affected.

For any building built before 2000 (as far as reasonably practicable) all asbestos or ACM (asbestos containing material) should have been identified by a suitably qualified and experienced person.

At present there are many buildings in the Marlborough region yet to be surveyed for asbestos. The Marlborough District Council requires an Asbestos Report to be submitted at the time of lodging a Building Consent for demolition, refurbishment or alteration.

An Asbestos Management Plan has been a regulatory requirement for all commercial buildings since April 2018. There is no longer leeway for PCBU’s if they do not comply with the regulations. There is also the ability to impose hefty fines included in the Act.
